Terms of Use

These Terms of Use govern access to and use of the LANYVA website, applications, marketplace services, and related features.

By accessing the Platform, creating an account, listing a product, or placing an order, you confirm that you have read and accepted these Terms. If you do not agree, you must not use LANYVA.

Users must be at least 18 years old and legally capable of entering into a binding agreement.

When creating an account, you must provide accurate, complete, and current information. You must not:

• Use another person's identity

• Create an account for fraudulent purposes

• Provide false business or payment information

• Transfer or sell your account without approval

• Use an account that has been suspended

You are responsible for keeping your password and account credentials secure. Notify LANYVA immediately at support@lanyva.com if you suspect unauthorized access.

LANYVA may request identity, address, commercial registration, tax, banking, or other documents for verification.

LANYVA may restrict, suspend, or close an account where reasonably necessary to:

• Prevent fraud or unlawful activity

• Protect customers, sellers, or the Platform

• Investigate policy violations

• Comply with legal requirements

• Address repeated misuse of returns, payments, reviews, or promotions

Account closure does not remove obligations relating to pending orders, refunds, chargebacks, seller payouts, disputes, or legal recordkeeping.

LANYVA currently supports eligible deliveries within Saudi Arabia and the UAE.

Available shipping methods, charges, and estimated delivery times will be shown during checkout.

Delivery times are estimates unless expressly confirmed as guaranteed. Delays may result from:

• Seller processing

• Product availability

• Public holidays

• Weather

• Courier disruptions

• Customs inspections

• Incorrect addresses

• Recipient unavailability

• Events outside reasonable control

Products from different sellers or fulfilment locations may arrive in separate packages, through different couriers, and on different dates.

Buyers must provide a complete physical delivery address and active telephone number.

Additional costs may apply where delivery fails because of an incorrect address, refusal to accept a valid delivery, recipient unavailability, or failure to collect a package.

Risk of accidental loss or damage remains with the responsible seller or fulfilment party until delivery to:

• The Buyer

• An authorized recipient

• An approved collection point

• Building reception or security where reasonably authorized

• Another location selected by the Buyer

Cross-border deliveries between Saudi Arabia and the UAE may be subject to customs duties, import taxes, VAT, or documentation requirements. Unless included at checkout, these charges are the recipient's responsibility.

Returns, refunds, exchanges, and cancellations are governed by LANYVA's Return and Exchange Policy and applicable consumer law.

All return and exchange requests must be submitted through LANYVA.

Buyers must not send products directly to a seller, warehouse, or other address without receiving approved return instructions and, where required, a Return Merchandise Authorization.

Unless the product is defective, damaged, incorrect, or otherwise protected by law, returned products must generally be:

• Unused, unworn, unwashed, and undamaged

• In their original condition

• Returned with original tags, packaging, accessories, and complimentary items

• Submitted within the applicable return period

Certain products may not qualify for change-of-mind returns, including:

• Intimate apparel

• Opened cosmetics or personal-care products

• Products with removed hygiene seals

• Personalized or made-to-order products

• Perishable products

• Digital products and gift cards

• Products clearly marked as final sale before purchase

These exclusions do not apply where a product is defective, damaged, incorrect, unsafe, or materially different from its description.

LANYVA or the responsible seller will cover reasonable return shipping costs where the product is defective, damaged, incorrect, or misdescribed.

The Buyer may be responsible for shipping costs for an eligible preference-based return or exchange.

Approved refunds will normally be issued to the original payment method. Banks and payment providers may require additional processing time.

Buyers may request cancellation before dispatch, but cancellation cannot always be guaranteed after order processing has started.

LANYVA may cancel an order because of:

• Product unavailability

• Payment failure

• Pricing or listing errors

• Suspected fraud

• Shipping restrictions

• Product safety concerns

• Legal requirements

A paid order cancelled before successful delivery will be refunded where eligible.

The Platform and its original content, including software, branding, designs, graphics, text, databases, and marketplace features, are owned by or licensed to LANYVA.

Users receive a limited, personal, non-exclusive, and revocable right to use the Platform for lawful shopping, selling, or account management.

Without written authorization, Users must not:

• Copy or commercially exploit Platform content

• Use LANYVA's name, logo, or trademarks

• Reverse-engineer Platform software

• Create a competing database from Platform information

• Scrape product, seller, price, review, or customer data

• Use Platform content to train an artificial intelligence system

Users retain ownership of content they lawfully submit.

By submitting User Content, Users grant LANYVA a non-exclusive, royalty-free licence to host, display, reproduce, format, translate, and use the content as reasonably necessary to operate and promote the Platform, process orders, provide support, prevent fraud, and meet legal obligations.

Sellers authorize LANYVA to use their product names, photographs, descriptions, logos, trademarks, and brand materials for marketplace and marketing purposes.

Intellectual-property complaints may be submitted to support@lanyva.com with evidence of ownership and details of the allegedly infringing content.

Nothing in these Terms excludes:

• Mandatory consumer rights

• Liability for fraud or wilful misconduct

• Liability that cannot legally be excluded

• Duties arising under product safety, data protection, or consumer law

LANYVA will use reasonable care in operating the Platform but does not guarantee uninterrupted or error-free access.

Unless LANYVA is identified as the direct seller, the relevant seller is primarily responsible for product quality, safety, legality, authenticity, descriptions, inventory, and warranties.

The Platform may rely on independent couriers, payment providers, hosting providers, and other service providers. LANYVA is not responsible for their independent acts except where legally responsible.

To the fullest extent permitted by law, LANYVA will not be liable for indirect, incidental, or consequential losses that were not reasonably foreseeable.

For a Buyer claim relating to an order, LANYVA's total liability will not exceed the amount paid for the affected order, unless applicable law requires otherwise.

Sellers are responsible for claims and losses arising from:

• Unsafe or defective products

• Counterfeit goods

• Misleading product information

• Unsupported sustainability claims

• Intellectual-property infringement

• Seller tax or licensing failures

• Misuse of customer information

• Breach of these Terms or applicable law

No party will be responsible for delay caused by events outside its reasonable control, including severe weather, natural disasters, government action, border closures, major logistics interruptions, war, or widespread system failures.

Users should first contact LANYVA at support@lanyva.com and provide:

• Their name and contact information

• The relevant order or account details

• A description of the issue

• The requested resolution

LANYVA will make reasonable efforts to review and resolve complaints fairly.

These Terms are governed by the laws and regulations of the Kingdom of Saudi Arabia.

Subject to mandatory consumer rights, the competent courts of Riyadh, Saudi Arabia will have jurisdiction over disputes arising from these Terms or use of the Platform.

Customers located in the UAE retain any non-waivable rights available under applicable UAE law.

Nothing in these Terms prevents a User from contacting an appropriate consumer-protection, regulatory, governmental, or judicial authority.

If any provision is found invalid or unenforceable, the remaining provisions will continue in effect.

LANYVA may update these Terms to reflect changes in:

• Applicable law

• Marketplace operations

• Platform features

• Payment or delivery methods

• Security requirements

• Related policies

The revised Terms will be published with an updated effective date.

Where a change materially affects registered Users, LANYVA may provide notice by email, account notification, or another appropriate method.

Changes will not normally alter an order accepted before the revised Terms became effective unless required by law or agreed with the customer.

Continued use of the Platform after the effective date of updated Terms constitutes acceptance of those Terms.

These Terms may be available in Arabic and English. If the versions conflict, the Arabic version will prevail to the extent permitted or required by Saudi Arabian law.
